Liikelaitostumisen vaikutukset Case: Espoo Talouspalvelut

Espoo Talouspalvelut tuottaa Espoon kaupungille taloushallinnon palveluita. Yksikkö toimi kunnallisena liikelaitoksena vuosina 2013 – 2015. Opinnäytetyössä tutkittiin, mitkä olivat liikelaitostumisen vaikutukset Espoo Talouspalveluille. Tutkimuksen näkökulmiksi valittiin taloudellinen ja henkilöstön näkökulma. Lisäksi opinnäytetyössä selvitettiin liikelaitostumisen syitä ja sitä, miksi liikelaitosmuodosta kuitenkin luovuttiin.
Opinnäytetyössä tarkasteltiin ensin kuntaa liiketoiminnan harjoittajana ja sitä, miten kunta voi eriyttää liiketoimintansa. Tämän jälkeen tutustuttiin kunnalliseen liikelaitokseen, sen toimintaan ja taloudellisiin piirteisiin sekä itse case-yritykseen. Opinnäytetyössä oli sekä laadullisen että määrällisen tutkimuksen piirteitä. Aineistonkeruumenetelminä käytettiin haastattelua ja kyselyä.
Tutkimustulosten mukaan liikelaitostuminen on tuonut toimintaan kustannustehokkuutta. Liikelaitokseen liittyi olennaisesti toiminnan kehittäminen, jonka myötä organisaation kannattavuus on parantunut. Liikelaitoksessa jouduttiin myös erityisesti kiinnittämään huomiota budjetointiin sekä palveluiden hinnoitteluun ja tuotteistamiseen. Liikelaitostumisen myötä Hankintapalvelut-palveluyksikkö siirrettiin Espoo Talouspalveluihin. Työtehtävien määrä lisääntyi sisäisen työn osalta, koska laskuttamisen takia jouduttiin pitämään kirjaa tehdyistä työtunneista. Toisaalta henkilöstön palkka ei ollut muuttunut. Koska kaikki taloustoiminnot oli keskitetty Espoo Talouspalveluihin, yhteistyö toimialojen ja konserniesikunnan kanssa lisääntyi. Kaiken kaikkiaan voidaan todeta, että liikelaitosmuoto oli kannattava ja sen avulla saatiin poistettua aiempia toimintaan liittyviä ongelmia. Liikelaitosmuodosta kuitenkin luovuttiin, vaikka saadut tulokset olivat positiivisia. Tämä johtui siitä, että toimintamalli oli tullut kehitystiensä päähän eikä sillä voitu saavuttaa Espoon kaupungin asettamia uusia taloudellisia tavoitteita.

The subject of this thesis is communality in an online community. As the Internet is an extensive operating environment, the subject has been limited to mean Facebook communities. The objective of the thesis project is to understand which factors and community characteristics evoke a sense of communality among consumers in the digital environment. In addition, the intent is to study which online community features strengthen communal activities. The subject is also examined in terms of brand community. The subject is approached via qualitative research methods, by interviewing members of online communities and by observing a recreational community on Facebook. This will make it possible to base the results both on an user-oriented and operating environment -oriented understanding. Understanding consumer behavior will benefit companies that are interested in building communal activities around their brands online. This thesis is part of a multiyear Consumer Behavior in Digital Environment project, which is a domestic online research study carried out in cooperation between Laurea University of Applied Sciences, MTV and Kurio Oy. The study focuses on manifestations of communities and communality in real life and in the digital environment. In addition, the study examines the characteristics of the operating environment in terms of the subject. Brand communality becomes familiar through increasing customer-understanding. Research data for this thesis was acquired through thematic interviews and by netnographic observation. The data will be analyzed by using phenomenological and ethno-methodological approaches. Based on the data acquired personality profiles similar to the ones used in Service Design have been created. Two approaches will be used in order to obtain different perspectives on the theme. Two research material procurement methods and three analytical methods will be used in order to ensure diverse research results and to get as in-depth knowledge and understanding of the subject as possible. According to the results of the study conducted in this thesis the main communal value-added feature of an online community is an accepting and supportive attitude from other members. When the atmosphere in the group is positive, it encourages individuals to publish questions, comments and personal experiences. In an online community the communality comes from members sharing their own personal experiences to be read by other members, and others indicating their acceptance or identification by reacting to the publication in an expected way. Sense of communality refers to the sharing of similar emotional experiences and opinions, as well as providing peer support and assistance to people interested in the same subjects. The consumers sharing the same set of values can find each other through the brand and form a community in which they receive and provide peer support to each other. However, based on this study, the online platform offered by the brand is only utilized a little for collaborative action. Further study is recommended to examine a variety of online communities such as game-, brand- or discussion groups, as well as the consumer behavior in different age groups, because the purpose of the group, atmosphere and operating culture will affect how its members face the group and how the group will operate....

The United Nations' Convention on the Rights of the Child includes a commitment according to which, in all actions concerning children, the “best interests of the child” shall be a primary consideration. Finland ratified the convention in 1991. The “best interests of the child” can be said to be one of the key principles in the field of child law. The concept of the “best interests of the child” is wide covering as a general definition as any actions could be justified with it. This study examines, what this principle means and how it has been clarified in legislation. The aim is also to sort out how “the best interest of the child” can be evaluated and what kind of criteria there is in the legislation for evaluating “the best interest of the child”. The most essential part of child legislation in Finland is contained together in the Child Welfare Act and the Act on Child Custody and Right of Access. In addition, this study examines among other acts the Social Welfare Act and Health Care Act from a comparative perspective. The study is based on law, so it is based mostly on valid legislation. Also, the development of child law and its most significant cornerstones are shortly described. In addition, the study explores law drafting material, such as government bills, and legal literature. As an outcome, this study discovered that the legislator has wanted to protect the child well in itself. However, defining “the best interests of the child” is loose, or is not made at all at the legislative act level. Consequently this leaves the authority applying the law with a lot of discretion. However, this discretion is the key which enables individual and case-specific evaluation. Therefore, “the best interests of the child” comes true through consideration made in every single occasion. The goal of this thesis is to study what has been regulated in legislation regarding terminating the service of state officials and how the legislation in question has been implemented in reality in such dismissal situations. The perspective of this thesis is the position of the state official that is being dismissed and the security of his/her rights. Another goal of this thesis is to explain the different aspects of the legislation relating to state officials with the help of legal practice. Making the legislation more understandable will improve the position of the state official who is being dismissed in the sense of being able to consider his/her own rights. The thesis tries also to consider the courts assessments and the understandability of their justification for their decisions. This work is based heavily on the Finnish civil service law and its preliminary works. In the text the civil service law will be clarified regarding service termination. Several articles and other judicial literature has also been used as guidance. In the thesis the most essential legal practical situations have been used as examples to clarify the legislation. The idea for this thesis came from reading news regarding the recent large scale dismissals and co-operation negotiations relating to the state sector. When comparing the civil service law and its preliminary works and the recent legal practical sit-uations to one another, it became clear that even if the legal practice mainly supports what has been legislated in the law, in some cases there hasn’t been a clear opinion to be found in practice. I also found some cases where the matter had been decided against what the government had suggested in their presentation regarding the civil service law or what had been decided earlier in court. While working on this thesis I also found and considered the recent changes to the civil service law relating to a state official’s rights and the termination of service. The way these changes have been applied and the collective bargaining contracts which have been made (due to the lack of legislation) have led to a rather poor situation from the state official’s point of view. To correct this poor situation, I have presented in the deductions chapter of this thesis some suggestions to improve both the regulations concerning the termination of service and the state’s collective bar-gaining contracts and collective agreements. These suggested changes are given in order to improve the state official's status and would also be very important when considering how the whole of society works....
