The act on long-term savings entered into force in the beginning of 2010. It introduced a new alternative to voluntary pension insurance. The pension savings agreement (PS agreement) enables people to save through shares, bonds, investment funds and accounts. This savings form will also include tax incentives. This thesis compared direct investment in shares to investment under the PS agreement as a means of saving for retirement. Shares were chosen because the long-term nature of investments reduces the risk of investment and the risk/return reward is usually very good. The comparison took into account the profitability, taxation, costs and risks. The first case is where a person begins the pension saving at the age of 25 by saving a 100 € per month. An alternative situation is where a pension saving starts at the age of 50 and the amount saved yearly is 5000 €, which is the maximum annual deduction. Money saved under a PS agreement or pension insurance agreement can be deducted in taxation during the saving period. Also, the profits are tax-free before retirement. Yield calculations indicated that the earlier people started saving, the greater the effect of compound interest was. Secondly tax-free dividend income increased PS agreements profits, compared to direct investments. Investing the annual deduction as leverage gave over 40% growth in PS agreements. Political risks can reduce the attractiveness of the PS agreement. The government has proposed that next year the capital income tax rate be raised from 28% to 30%. There is also a great pressure to rise the statutory retirement pension age after the recent poor performances of pension insurance companies. On the other hand, possible tightening of dividend taxation would make the PS agreement more beneficial. Savings accrued under PS agreements can be withdrawn after reaching the statutory retirement pension age. Also, the withdrawal period is usually ten years. In turn, direct investments in shares in today's market are highly liquid. Savings accrued under a PS agreement can be transferred from one service provider to another without tax consequences. This has led to a price competition between some service providers. As a result, management costs have almost entirely disappeared and the PS agreement costs are very close to the ones of direct investment. This research focused only on differences between a PS agreement and direct investments in share markets. A PS agreement is not the right choice for everyone, because people have different demands for profit, risk, liquidity and so on. Obstacles to the debt arrangement and the weighty reasons The purpose of this thesis was to study how the process of hearing in the system of arrangement of debts progresses in the District Court and specially granting the arrangement of debts also when the arrangement of debts can be granted with weighty reasons despite an obstacle. Knowing this exception and the legal praxis might be important for the debtors. The result of this thesis will be an information package on the requirements of granting the arrangement of debts despite an obstacle. According to the law, the arrangement of debts can be granted despite an obstacle if there are weighty reasons considering the time of indebtedness, the debtor’s operations for paying the debts, the other conditions of debtor and the importance for the debtor and the creditor. The law does not define clearly which are the weighty reasons, but according to the legal cases the debtor’s operations and the time of indebtedness have often great importance. The District Court takes into consideration the conditions for the arrangement of debts, the obstacles and the weighty reasons when making a decision. Even one weighty reason might be enough for granting the arrangement of debts if the reason is strong enough. Legislation, legal literature and legal cases have been used as sources of this thesis. The new leave for continued consideration procedure : case: Helsinki Court of Appeal he topic of our thesis was to examine the leave for continued consideration procedure in Helsinki Court of Appeal, which is a part of the new appeal proceedings. We agreed on making the thesis with the head of office of Helsinki Court of Appeal, Kristina Kahlas-Capodistrias. The aim of our thesis was to research how the goals which were set regarding the new appeal procedure have actualized in the operations in Helsinki Court of Appeal, methods that in practice are associated with the procedure in matters of leave to continue the proceedings and the problems which have possibly occurred during the procedure. For our research we made an inquiry to jurisdiction and office personnel which are working with the matters of permission for further consideration. The second aim of the thesis was to accomplish an inclusive information package about the work tasks in general related to the matters of leave for continued consideration and especially secretary's assignments. As a result of our thesis we made instructions for these assignments for the office staff of Helsinki Court of Appeal. At the moment one secretary from every department is responsible for the assignments concerning the leave matters. The goal, however, is that in future it would be possible for every secretary to take care of these tasks. We hope that by exploring our thesis secretaries can get inclusive information about their new assignments. In the theory part of our thesis we examined the appeal system of general courts and changes that have earlier been made to it by using procedural literature. We told about the problems of screening procedure which preceded the leave for continued consideration procedure and the reasons why the appeal system needed to be changed. Using the legislative history we strive to find out what kind of goals have the legislators had when they created the new appeal system. Ultimately we introduce the new system in leave matters. We explored the effects of the leave for continued consideration procedure on office and law personnel's workload and methods and the amount of main hearings and the length of processing time. We also presented the problems which are caused by the leave for continued consideration and the means to solve these problems in Helsinki Court of Appeal. In our research we found out that in Helsinki Court of Appeal staff consider the new appeal procedure positive but it does not seem to have had much impact on the amount of main hearings or the processing times in the main hearing matters or the quickness of processing times in all of the matters resolved in Helsinki Court of Appeal, at least yet. All the effects of the leave for continued consideration procedure aren't yet to be seen because the new procedure has been in use only for a little while....

A detailed account of the rights of and support for a handicapped person and his or her family This thesis studied the services available to a disabled person and his family from a financial perspective and examined the relevant legislation. The target group was limited to a family with a school-aged Down syndrome child. The objective of the thesis is to clarify the legislation concerning the target group’s financial support and also to establish the services in outpatient care that are carried out at home. The services need to be surveyed, so that in the future it is possible to investigate the associated costs. The sources used in the thesis are derived from the relevant legislation, literature and electronic sources. The thesis introduces a general definition of mental retardation. It also examines the rights of mentally retarded persons and related laws. The main laws are the Social Welfare Act, the Mental Retardation Act, the Disability Services Act, the Mental Health Act, the Public Health Act, the Act on Specialized Care, the Child Welfare Act, the Patient Care Act, the Act on a Carer’s Allowance and the Rehabilitation Act. Finland’s disability services are presented at a general level, so that the reader can understand the extent of the service package in a disabled person’s life. These services include personal assistance, rehabilitation, various types of housing, work and daily activities, and hobbies. The support and services the mentally disabled person is entitled to according to legislation and what is required to have those services are presented in the thesis. The most important financial support the municipality provides for families are the service voucher and informal care support. The Social Insurance Institution in turn pays the child benefit, disability support for under 16-year-olds and money for rehabilitation during adaptation training and rehabilitation courses. To obtain financial support the family must fill in three forms, two of which vary according to municipality. The Special Care Program and the Service and Care plan varied according to municipality, but the Social Insurance Institution’s Rehabilitation plan is in general use around Finland. At the end of the thesis an imaginary family and their basket of services are presented as an example. The basket includes the customer’s everyday services, which include school, morning and afternoon activities, transportation and also the services of a personal assistant, a rehabilitation counselor and a foster keeper. In addition, analysis of the fictional handicapped family’s income and expenditure is provided, with the purpose of highlighting the extent to which a disabled family’s life differs from other families, and the issues that must be taken into account in everyday life....

Legal proceedings of criminal cases, restraining orders and a processing guide to criminal cases BBA and my major Legal Expertise include practical training in legal environment. I completed my practical training in Vantaa District Court and interested in especially about the procedure of criminal cases. This thesis is about the criminal cases which need to be tried on a main hearing. Some of the criminal cases can be also conversed in written procedure with certain requirements but most of criminal cases urges to be tried on a main hearing because of the crimes composition. In my thesis I am viewing cases mostly based on secretarial work. After the examination of normal criminal case I will engross in to cases of restraining orders for the current of those cases. The main interest of my thesis is to create a guide for the secretaries who are working with criminal cases. The thesis is made especially for Vantaa District Court where I am still working after my practical training. There has been appearing need for this kind of guide for there is so much things to be remembered and taking care of in secretarial work. This thesis is separated into two segments. In the first segment I am examining the criminal procedure by laws and the literature of justice. After that I am engrossing in to the cases of restraining orders. Restraining orders are non-contentious civil cases but are tried like criminal cases in District Courts. Within making this thesis I have interviewed Vantaa district Courts judge Heli Pöntinen and also secretary Jenni Iivonen. As a result of this thesis existed the guide for secretarial work in Vantaa District Court. In this guide secretaries will find advices which are meant to ease everyday working....

Agentin ja päämiesyrityksen välisen suhteen kriittiset menestystekijät, case BOCO – Nordic Board Agents and Consultants Ltd.

Tämän opinnäytetyön aihe ja teoreettinen tausta perustuvat markkinoiden nykyiseen globaaliin kehitykseen ja siitä seuranneeseen kiristyneeseen kilpailutilanteeseen, joka on luonut monelle teolliselle yritykselle tarpeen markkina-alueensa laajentamiseen. Monet pitävät laajentamista äärimmäisen tärkeänä yrityksen pitkäaikaisen menestymisen kannalta. Uudelle alueelle siirtyminen voi tosin olla äärimmäisen haastavaa. Prosessin helpottamiseksi yrityksen valmistaman tuotteen vienti ja jakelu voi tapahtua uudessa kohteessa useissa erilaisissa muodoissa. Yksi näistä vaihtoehdoista on agentuuriyrityksen käyttö yhteistyökumppanina.
Agentin avulla yritys voi vaivattomasti ja kustannustehokkaasti etabloitua uudelle markkina-alueelle, jolloin se toimii yhteistyösuhteessa päämiehenä, jonka lukuun agentti suorittaa myyntiä ja markkinointia. Agentin käytön vahvuudeksi voidaan katsoa sen vaivattomuus – agentin tehtäviin kuuluu hoitaa myyntineuvottelut ja asiakassuhteiden hoito uudella markkina-alueella, jolloin päämiesyritys voi käyttää omat resurssinsa ydinosaamisensa kehittämiseen. Onnistuneessa agentti-päämiessuhteessa molemmat osapuolet muodostavat keskenään eräänlaisen symbioosin, josta molemmat hyötyvät.
Opinnäytetyön hankeyrityksenä toimii BOCO - Nordic Board Agents and Consultants Ltd, joka on vuonna 1999 perustettu, kahdeksan henkeä työllistävä agentuuriyritys. Yrityksen toimitilat sijaitsevat Helsingin Lauttasaaressa ja sen toimiala on paperi- ja kartonkiteollisuus. BOCO:n päämiessidosryhmä koostuu 12:sta, pääosin ulkomaalaisesta, paperia ja kartonkia valmistavasta teollisuusyrityksestä. Yritys pyrkii olemaan päämiehilleen pitkäaikainen ratkaisu pohjoismaisten ja Venäjän markkinoiden kokonaisvaltaiseen hallintaan.
Opinnäytetyö tutkii agentuuriyritysten toimintaa nykytrendien mukaisessa markkinaympäristössä. Työssä perehdytään agentuuritoiminnan tyypillisiin etuihin, haasteisiin ja tärkeimpiin velvollisuuksiin sekä agentin itsensä että agentin palvelua käyttävän päämiesyrityksen näkökulmasta. Lisäksi syvennytään tutkimaan tarkemmin paperi- ja kartonkialalla toimivaa suomalaista agenttiyritystä ja kehittämään sen nykyisiä toimintamalleja. Työn teoriaosuus pohjautuu lähteisiin, jotka käsittelevät kattavasti yritysten nykyistä tarvetta kansainvälistyä, agenttiyrityksen toimintaa sekä siihen liittyviä lakeja, sopimuksia ja velvoitteita. Opinnäytetyön tarkoituksena on selvittää tutkimuksen avulla agentti-päämiessuhteen kriittiset menestystekijät.
Varsinainen tutkimustyö on tehty kyselylomakkeeseen perustuvana kvantitatiivisena kyselynä, jonka otoksena on ollut hankeyrityksen päämiesjoukko. Tutkimustulosten perusteella voidaan todeta, että kriittiset menestystekijät agentuuriyrityksen ja tämän päämiesten välillä ovat luotettavuus, tiedon välitys ja asiantuntemus. Tämän lisäksi tutkimuksen mukaan päämiehet arvostavat pitkää kokemusta toimialalta ja markkina-alueelta, tuotetietoutta sekä selkeää tilausten dokumentointia ja seurantaa. Kokonaisuudessaan agentin käyttäminen koetaan hyvänä vaihtoehtona etabloiduttaessa uudelle markkina-alueelle....

Excess inventory’s identification, elimination and prevention. Case: Yritys X This thesis has the mandate from Yritys X. It is a warehouse development project, which is designed to identify, eliminate and prevent excess inventory as well as the formation of new excess inventory. The aim is to investigate the causes of excess inventory accumulation and warehouse stagnation and to investigate what kind of products can cause excess inventory and the old stock. This thesis is a project work as part of the job training. Yritys X is a technical wholesale importer and a seller of commercial heating, water treatment and HVAC products. The most important product groups include heat pumps, solar heating systems, boilers, oil and gas burners, water treatment equipment, mixing valves and the regional and district heating pipes. My thesis consists of two parts; theoretical and empirical. The theoretical part is taken from various reports of warehousing and storage in general. In addition storage costs and indicators are part of the theoretical section. I started my thesis by collecting all the theoretical knowledge of key figures and costs of the storage as well as excess and old inventory. The empirical part consists mainly of interviews. I interviewed heads of different departments in order to get a clear idea of what each person thought about the company inventory and how it should function. In addition, I received a lot of inside information to help me to analyze the different stages in my project and to come to right conclusions. Based on the theory and the interviews I produced an Action Plan, which includes my ideas to develop inventory system. The Action Plan contains of the means by which excess inventory and old stock is removed, and it explains the results of these measures and above all, describes where responsibilities lie. In the near future the company will introduce a new information system, which will make the inventory control system more efficient. The ideas presented in my Action Plan will be used as tools when deciding how to improve and develop inventory cycle. The results of the development project have shown that in the development of the warehouse co-operation, up-to-date data, systematic approach, active monitoring and correct distribution of responsibilities are the key elements...

Yhteistoimintamenettelyn kehittäminen Helsingin hallinto-oikeudessa
– uusi virastokohtainen yhteistoimintasopimus

Olen työskennellyt Helsingin hallinto-oikeudessa vuodesta 2001 lähtien useissa erilaisissa kansliatehtävissä. Vuoden 2010 alusta minut valittiin toimistohenkilöstön edustajaksi viraston yhteistyökomiteaan ja samalla alkoi myös varaluottamusmiehen toimeni. Luottamustoimiin ryhtyessäni ja yhteistoimintalainsäädäntöön, voimassa oleviin oikeushallinnon alan ja oman virastomme yhteistoimintasopimuksiin tutustuttuani totesin, että Helsingin hallinto-oikeuden yhteistoimintamenettely samoin kuin vuodelta 1990 peräisin oleva yhteistoimintasopimuskin olivat jääneet pahasti ajastaan jälkeen. Ne eivät olleet omiaan edistämään yhteistoiminnan tavoitteita eli henkilöstön vaikuttamis- ja osallistumismahdollisuuksien toteuttamista ja työnantajapuolen ja henkilöstön keskinäisen vuorovaikutuksen edistämistä. Otin asian puheeksi hallinto-oikeuden ylituomarin Marjatta Mäenpään kanssa ja keskustelumme tuloksena sovimme, että laadin oikeustradenomiopintoihini kuuluvan opinnäytetyöni yhteydessä kesän ja syksyn 2010 aikana Helsingin hallinto-oikeudelle ajanmukaisen ja toimivan virastokohtaisen yhteistoimintasopimuksen luonnoksen.
Lokakuussa 2010 astui voimaan oikeushallinnon alan uusi yhteistoimintasopimus ja sen vuoksi valmistelin kaksi eri luonnosta virastokohtaiseksi sopimukseksi; toisen, joka pohjautui tähän koko hallinnonalan sopimukseen ja toisen, joka pohjautui Helsingin hallinto-oikeuden tuolloin voimassaolevaan sopimukseen. Lausuntoa ja kommentteja näistä luonnoksista antoivat viraston johdon lisäksi luottamusmiehet sekä eri henkilöstöryhmien edustajat. Lausuntokierroksen jälkeen järjestettiin tammikuussa 2011 neuvottelut, joissa lopulta hyväksyttiin ensin mainitun luonnokseni pohjalta Helsingin hallinto-oikeudelle uusi yhteistoimintasopimus.
Opinnäytetyöni teoriaosuudessa tarkastelen muun muassa, mitä valtion yhteistoiminta tarkoittaa lainsäädännön ja sopimusten valossa ja kuinka sitä Helsingin hallinto-oikeudessa to-teutetaan. Käsittelen myös yhteistoimintalain uudistamissuunnitelmia. Oikeudellisina lähteinä olen käyttänyt lakeja sekä työ- ja virkamiesoikeudellista oikeuskirjallisuutta sekä muuna ma-teriaalina sopimuksia, viranomaisten ja ammattiliittojen palvelusivustoja, ammattiliittojen koulutusmateriaaleja sekä hallinto-oikeuden henkilöstön ja ammattiliittojen edustajien haastatteluissa hankkimiani tietoja.
Tämän projektin lopputuloksena Helsingin hallinto-oikeudella on nyt kaikkia osapuolia tyydyttävä, nykyaikainen ja selkeä yhteistoimintasopimus, jonka toivon edistävän yhteistoiminnan tavoitteiden toteutumista....
