The theoretical background of this thesis is constructed to the base of a legal framework for public procurement concerning electronic procurement issues. In the theoretical part, development of the European Union (EU) and its primary and secondary EU-law issues and the consecutive progress in the EU directives is described. In addition to that the operational environment concerning the electronic procurement scope is scrutinized and revealed. The electronic procurement process is conceptually a vast issue where there are various dimensions. The theoretical frame of references creates a foundation, premises and comprehension for the interest of this thesis. The aim of this thesis was to examine the electronic public procurement process and the utilization of electronic tendering devices in use by the public-sector procurement contracting authorities in some municipalities in Finland. The focus in this study was on the pre-award phase where e-tendering is a main purpose for procurement to proceed. Specifically, the contracting authorities and their ability to comply within the spirit of the law regulation is at stake. The main question in this thesis was constructed from the legal framework and its expectations. The main question was constructed as follows: How the contracting entity utilizes electronic procurement devices? From the methodological point of view this is a quantitative study. The empirical data was obtained with an e-survey. The survey was sent to thirty municipal procurement authorities. In the survey, there were 16 questions in all. Five of them were background questions and the rest of the questions were focused on the utilization of e-procurement devices. According to the results of this survey it can be notified that the electronic procurement devices ease the execution of the procurement. Results reveal that there are still municipalities which do not use and utilize the electronic procurement devices in all phases of the public procurement process. It can be stated that they do comply with their duty to disclose mandatory requirements set out by the regulatory law. There are still some evolutionary proceedings to make in the public procurement to achieve efficiency and economic benefits and the follow up in it....

The purpose of the thesis is to find out how the employee is protected from unbalanced employment contracts and unfair terms of employment. Attention is focused especially on agreeing on the main terms of the employment contract. The thesis also clarifies how the main terms of employment obligates the parties during the employment relationship and to what extent the employer may change the terms of employment based on his right to direct. The research method of the thesis was mainly legal-dogmatic meaning that the aim of the thesis was to interpret and systematize the content of the law through; legislation, legislative history, case law and legal literature. The thesis also analyzes the underlying principles and interests behind the regulation and their influence. These principles and interest are also taken into account when evaluating different interpretation options. The research method is also partly legal-historical as the thesis examines how the legislation has evolved in its present form and where certain needs for change come from. The key principle of labour legislation, the principle of employee protection, is the idea of an employee as a weaker party. The employer and the employee are not regarded as capable of making fair enough contracts. Therefore, one of the most important aims of labour legislation is to improve the position of the employee. This is mainly done by limiting the parties’ contractual freedom through mandatory provisions based on minimum labour legislation and collective labour agreements. Labour legislation contains restrictions on many "key" terms of employment in order to protect the employee. These restrictions concern; temporary employment contracts, probationary periods, wages, maximum working hours, varying working hours and minimum length of annual leave. Collective agreements usually contain detailed provisions on the terms applicable to the employment contract. Based on the study carried out in the thesis, it can be concluded that labour law and collective agreements generally secure comprehensively minimum terms of employment. The employment contract is legally binding agreement between employer and employee. However, according to the Employment Contracts Act and based on the employment contract the employer is entitled to direct work and unilaterally change the terms of employment within its competence. The employer’s right to direct has been considered as a contractual matter. What is important in assessing the extent of the employer’s right to direct is what is agreed in the employment contract. The general principle is that the employer may only make minor changes, the employer’s right to direction doesn't cover essential changes. The assessment of the changes is case-specific and varies under different terms, for example wages may not normally be changed solely based on an employer’s right to direct, the terms concerning workplace, work tasks and working time may instead be changed more easily. The employee's negotiating position in relation to the employer can be improved by emphasizing employees' awareness of the labour legislation and their own rights regarding the terms of employment as well as providing the employee enough information about the "key" terms of their employment relationship. In addition, agreeing in writing on the main terms of employment will increase employee’s awareness of the terms of employment and the ability to exercise control over their rights....

Opinnäytetyön toteutustapana on toiminnallinen ja kehittämistyönä tehtävä opinnäytetyö, jossa yritys tuodaan digitaaliseen toimintaympäristöön perustamalla yritykselle toimivat kotisivut ja Facebook-sivut. Opinnäytetyön tietoperusta pohjautuu markkinointiviestinnän alan kirjallisuuteen ja Internet-lähteisiin. Lähteinä on käytetty myös ammattiblogikirjoituksia, koska ne tarjoavat ajankohtaista tietoa nopeasti kehittyvästä digitaalisesta markkinoinnista. Lähialueen yritysten kanssa voisi kehitellä yhteistyökuvioita, joista kukin osapuoli hyötyy. Palvelukokonaisuuksien ja palveluhinnaston luominen ja esille laittaminen yrityksen kotisivuille. Yhtenä kehitysehdotuksena on sisältökalenterin laajennus. Myös kotisivuja voisi laajentaa palvelukuvausten osalta. Yritys voisi tulevaisuudessa ottaa myös outbound-markkinoinnin keinot osaksi digitaalista markkinointiviestinnän kokonaisuutta....

The purpose of the thesis was to clarify an inner supporting process of the commissioner of this paper, a domestic office and professional services providing company, and also to develop the process. The aim was to clear up the current state of the operations of the team responsible for the supporting process, the Selvittelytiimi, by the aspects of general and personal work organization, clarity of job descriptions and job-specific time management. The second aim was to study how these aspects affect the flow of the supporting process. The subject of the thesis came straight from the commissioner, who is going to use the thesis for clarifying their work monitoring and for their own project to build up indicators for measuring the service and quality of the team. The theoretical framework of the research came up from process development on the common level and from theory of work organizing, clear job descriptions and work hours and monitoring. The theoretical section of this thesis also treats Taylorism and Lean, both which are strongly related to process development. Especially Lean thinking was used throughout the whole paper and the research carried out. The study was carried out as a qualitative research and the data was collected with observation method. The observation period was from January till April 2018. Members of the Selvittelytiimi were selected for the observation in the order set by the team’s roster and other schedules so that for seven tasks of the team, there were three different persons observed for about an hour at a time for each task. Hand-written notes were taken while observing and later on the notes were written out in a computer and assembled task-specifically as a compilation file. The current state of the work organizing, clarity of job descriptions and the use of time is clearly seen from the results of the study. With the results the process can easily be developed by clarifying the job descriptions, unifying the working methods and improving the team’s work organizing as well as everyone’s personal organizing. By improving these things, the use of time will become more sensible and effective. The results of this thesis advance the annual targets of both the Selvittelytiimi and the whole company and potentially improve the working and scheduling of the team members. However, the research can be continued for example by observing the other tasks of Selvittelytiimi that were not included in this study. The results of the research can also be made more accurate by collecting more data for example from the team’s old working time records. The observation can also be done with a more wide scope so the material to be analyzed will be larger and the results obtained may be even more accurate and diverse. Keywords: process development, work hours, work organization, job description, financial administration....

The objective of this thesis was to understand the Finnish Value Added Tax (VAT) law better and to prepare a practical guide for the service centres of the Company X in Poland and India. The purpose of this guide is to help and speed up the handling processes of purchase invoices in the Company X. The theoretical framework of this thesis encompasses the handling processes of purchase invoices, the VAT law and the guide. The invoice handling processes are first examined from a theoretical point of view and then from the point of view of the Company X. In the section on VAT the tax rates used in Finland as well as the right to deduct are examined. In the last section of the theory part, a definition of a guide is presented and more details given to describing a good guide. The guide was made as a Power Point -data packet. At the beginning of the guide, there is a short definition of VAT and the basic rules for tax liability. The tax rates used in Finland are presented and reviewed using the most usual vendors of Company X as examples. VAT on international invoices is briefly reviewed but the main focus is on the right to deduct. The guide explains the reasons behind the right to deduct and clarifies the conditions for it to occur. Exceptions to the right of deduction are presented and again with examples of the most common vendors of Company X. Guidance on handling the purchase invoices from the VAT point of view has been added to the end of this guide. Feedback regarding the guide was received from a representative of the contracting company, but, unfortunately due to time limitations, feedback was not received from the target audience in the service centres. As a further development proposal it is suggested that after the publication of the guide, feedback on the usability of the guide could be collected also from the service centres and based on that feedback, the guide could be made more functional. The visuality of the guide could also be developed....
