The aim of this thesis was to define legal design by using systems theory as a research framework. During recent years, legal design has gained increasing public interest as a method to solve and prevent legal problems by creating user-friendly legal infromation, products and services. However, legal design does not yet have an established definition. Nor does it have a general theory that would explain the emergence of legal design or the reason why design has significance in the legal system. In general, there is only little academic research about the subject. This thesis aims to fulfill this research gap by offering one possible explanation of legal design. The thesis builds theoretical foundations for the schorlarly analysis of legal design, and calls attention to perspectives of the legal system that are relevant when applying design in the world of law. The methodological approach of this thesis is theoretical. Theoretical researches play an important role in constructing and systematizing knowledge, especially in the development of new fields of information. This thesis uses methods of conceptual analysis to define the essence of legal design. The analysis is made by using Niklas Luhmann’s systems theory as a research framework. Systems theory seeks to illustrate social phenomena holistically and objectively from a “birds-eye view”. This makes it a useful research tool for observing abstract and complex phenomena, such as law and design, and their relationship. Futhermore, systems theory makes it possible to combine various fields of research, such as sociological and legal theories, behavioral sciences and psychology, into one framework, which gives this thesis an interdisciplinary twist. This thesis explains how law as a social system based on human communication is constantly trying to adapt to the needs of increasingly complex society. Legal design can be seen as an emerging new phase of this ongoing process. Law’s social duty is to create predictability by producing normative expectations, which people can use in planning and anticipating possible future events. This way law also seeks to guide human behavior. However, the effectiveness of legal guidance is dependent on the quality of law’s communication. Any communication that aims to influence needs to be understandable, accessible and acceptable for the recipient. Law has traditionally pursued to optimize its communication by using its own methods, such as creation of legal regulation. In complex modern society these methods are not sufficient: they are inherently bounded based on reduced version of reality and create more complexity. This is the reason why law needs support from design to improve its communication. This thesis points out how interdisciplinary and human-centric approaches and methods of design can help the legal system to create a resonant frequency between the law and the human, but also between the law and the other social systems. This connection offers possibilities for the legal system to receive necessary information about how humans and other systems function, what their needs are and what they perceive as desirable. This information can help the legal system to improve its communicational performances – legal information, legal products and legal services – to satisfy the needs of modern human society....

The completion of this thesis was motivated by the process of rapid social change, where the forms of work change, and employment relationships diversify. The social change requires both structural change and the commitment and ability of citizens to make active decisions for the sustainability of society. It can be argued that it’s particularly important for people who are considering entrepreneurship or staring their transition from student life to working life to know the various criteria for sustainable business, thus influencing a sustainable future. The societal situation justified the development task of how teaching can contribute to the formation of students’ values as the development of skills in vocational education plays an important role in supporting citizens' sustainable decision-making capacity. The thesis was carried out during 2021 at Omnia's Leppävaara campus and the subject of the study was the experience of one group of students regarding their own possibilities to influence the sustainable future as a consumer, employee, and entrepreneur. In addition, the thesis examines students' understanding of sustainability and their awareness of the forces of change and megatrends as drivers for the future. The aim was to develop and strengthen the value base of students' eco-social thinking and Bildung and to enable the development of abilities and knowledge into motivation. A student who is motivated by social, economic, and environmental responsibility can apply the model of eco-social culture of responsibility, interpersonalism and reasonableness further in their behavior as a consumer, employee, and entrepreneur. The thesis was conducted as a development work, in which the methods of qualitative case research were applied. The qualitative methods were supplemented by means of questionnaires. The material for the development work was collected through questionnaires and observation of a group of students. The development task sought to understand the target group of students, changes in their experience and understanding, and the ability to detect future drivers. It was possible to answer development questions in part through empirical material. The results show that teaching can influence current thinking patterns and the accumulation of knowledge. In the right environment, the use of a new knowledge base is linked to the student’s own values and moral perceptions that enable action. And in this case, the target group’s knowledge of the elements of responsible business, their own opportunities for influence and their ability to perceive the future were initiated. Further research and development from the perspective of a sustainable future and responsibility should be extended to the teaching of vocational subjects, either on a sectoral basis or as cross-cutting research in different fields. The review of the topic should focus on how the responsibility of ecology, sociality and economics is addressed and linked to practical exercises during studies. In addition, there is a need for stronger joint development in the teaching of professional and common units of the degree and the experimentation with diverse implementation models.
