Oikeustulkkauksen haasteet

Abstract

Opinnäytetyön aiheena on välittömässä oikeudenkäynnissä tapahtuvan oikeustulkkauksen haasteet tilanteissa, kun käräjäoikeus tilaa tulkin asian käsittelyyn. Opinnäytetyön tarkoituksena on selvittää, miten käräjäoikeuksien ja tulkkien välistä yhteistyötä voisi parantaa sekä mistä erimielisyydet käräjäoikeuksien ja tulkkien välillä johtuvat.

Opinnäytetyön tutkimusmenetelminä ovat lainoppi sekä laadullinen tutkimus, joka on suoritettu tekemällä teemahaastatteluita tulkeille ja Espoon käräjäoikeuden edustajille syksyllä 2015. Keskeisimpiä lähteitä opinnäytetyössä ovat kielilaki, laki oikeudenkäynnistä rikosasioissa, oikeudenkäymiskaari, ulkomaalaislaki sekä näiden lakien lainvalmisteluasiakirjat. Pääpaino on Euroopan parlamentin ja neuvoston direktiivissä 2010/64/EU oikeudesta tulkkaukseen ja käännöksiin rikosoikeudellisissa menettelyissä. Direktiivi on annettu 20.10.2010. Lähdeaineisto perustuu myös Suomen kääntäjien ja tulkkien liiton internertsivuihin, joista löytyy muun muassa tulkkien ammattieettiset säännöstöt ja oikeustulkkausohjeet.

Oikeustulkkien erikoisammattitutkinto on mahdollista suorittaa ensimmäistä kertaa keväällä 2016. Koulutus on aloitettu kielissä, joissa oikeustulkkaukselle on eniten tarvetta. Oikeustulkkien erikoisammattitutkinto lisää muodollisesti pätevien oikeustulkkien saatavuutta. Direktiivillä on myös asetettu täytäntöön pantavaksi oikeustulkkirekisteri riittävän pätevyyden omaavista tulkeista, ja laki oikeustulkkirekisteristä tulee voimaan 1.4.2016. Käytännössä oikeustulkkirekisteri ei tule kuitenkaan palvelemaan sen käyttäjien tarpeita riittävissä määrin vielä vuosiin.

Opinnäytetyön johtopäätöksenä voidaan todeta, että konfliktit tulkkien ja oikeuslaitoksen välillä johtuvat informaation ja luottamuksen puutteesta. Viranomaisilla ei useinkaan ole tietoa tulkeista ja niistä tekijöistä, jotka tekevät heidän työnsä mahdolliseksi. Käräjäoikeuden edustajat suhtautuvat epäröiden oikeudenkäyntimateriaalin ennakkoon toimittamiseen. Tulkeille taas huolellinen valmistautuminen on osa ammattietiikkaa ja edellytys työn onnistumiselle. Lisäksi viranomaiset odottavat tulkilta sanasta sanaan -kääntämistä googlemaiseen tapaan. Jotta henkilöiden oikeusturva ja -varmuus voidaan taata myös tulevaisuudessa, on ensiarvoisen tärkeää panostaa tulkkien ja oikeuslaitoksen väliseen yhteistyöhön. Näin luottamus osapuolten välille ja yksimielisyys tulkin työn onnistumisen edellytyksistä voidaan saavuttaa.

The topic of this thesis deals with the challenges of court interpreting at a situ trial in cases in which the interpreter is required by District court. The purpose of the thesis is to solve how the co-operation between the interpreters and the District Court could be improved and where misunderstanding between these parties arise.

The research methods are jurisprudence and qualitative survey, which is carried out by conducting theme interviews to the interpreters and representatives of the District Court of Espoo in Autumn 2015. The central source materials comprise Language Act, Criminal Procedure Act, Code of Procedure, Aliens Act and the documents related to law drafting. The main focus is on the European Parliament and Council Directive 2010/64/EU the right for the interpretation and translations in the criminal proceedings. The directive is accorded on 20 October 2010. The source material is also based on the set of rules of interpreters’ occupational ethics found on the website of the Finnish Association of Translators and Interpreters.

Specialist Qualification in Court Interpreting was started in 2015. Training began in the languages with the greatest demand. Specialist Qualification in Court Interpreting will significantly increase the availability of qualified court interpreters. The register of court interpreters is set to be enforced by the directive and the Law of The Court Interpreters’ Register comes into force on 1 April 2016. In practice, however the amount of the interpreters will be insignificant for years.

According to the thesis results, conflicts between interpreters and the judiciary emerge from the lack of information and trust. The authorities do not often have knowledge about interpreters or the factors which enables the interpretation. The representatives of the District Court were unwilling to deliver the trial material beforehand. On the other hand, careful preparation is an important part of interpreter's professional ethics. Moreover, the authorities expected the interpreter to deliver the word for word –translations in a google-like manner. It is vital to invest in co-operation between the interpreters and the judiciary so that the legal protection and security can be guaranteed also in the future. In this way trust between the participants can be developed. In addition awareness of the factors affecting the success of the interpreters should be created.
