Kaksijäsenisten ratkaisukokoonpanojen käyttöönotto vakuutusoikeudessa

Abstract

Tässä opinnäytetyössä perehdytään vakuutusoikeuden toiminnan kehittämisen tuloksena syntyneen lakiehdotuksen mahdollistaman kaksijäsenisen ratkaisukokoonpanon käyttöönottoon. Teoriaosuudessa käsitellään vakuutusoikeuden toimintaa, työjärjestystä ja vakuutusoikeuden toiminnan kehittämistä. Lisäksi työssä käsitellään ehdotusta laiksi vakuutusoikeuden muuttamisesta ja käydään läpi tärkeimpiä vakuutusoikeuden toimintaan vaikuttavia lakeja. Käytännön osuudessa käydään läpi haastattelujen ja kyselyn tuloksia sekä esitetään toimintaohje kaksijäsenisen ratkaisukokoonpanon käyttöönottoa varten.

Työn tavoitteena on tutustua vakuutusoikeuden toiminnan kehittämiseen liittyvään aineistoon ja muodostaa vakuutusoikeudelle toimintaohje kaksijäsenisen ratkaisukokoonpanon käyttöönottamiseksi. Toimintaohjeen tulee olla selkeä ja yksinkertainen.

Toimintaohjeen suunnittelun pohjana on käytetty vakuutusoikeuden lainkäyttöhenkilökunnalle suunnatun kyselyn tuloksia sekä henkilökunnan haastatteluja. Toimintaohjeessa on esitetty ratkaisuehdotukset tärkeimpiin kaksijäsenisen ratkaisukokoonpanon käyttöönottoon liittyviin ongelmakohtiin kuten asioiden jakamiseen kevennetyn ja peruskokoonpanon välillä, kokoonpanoehdotuksen tekijään sekä työjärjestykseen.

Työn tuloksena syntynyt toimintaohje antaa edellytykset toimia uuden lainsäädännön mukaisesti. Ohje säästää vakuutusoikeuden työntekijöiden aikaa ja helpottaa uusiin käytäntöihin siirtymistä, koska uudistukseen liittyvät ongelmakohdat on ohjeessa ratkaistu.

This thesis is a study about the implementation of a two-member panel of judges in the Insurance Court. The goal of the new panel of judges is to shorten the times of hearing. The theory of the thesis concentrates on introducing the matters dealt with by the Insurance Court, how the Insurance Court is organised and how its operations could be enhanced. In addition, it presents the draft bill about improving the Insurance Court and highlights the most important laws that regulate its actions. The thesis also shows the results of an inquiry and the interviews conducted and it includes a proposal on how to implement the two-member panel of judges in the Insurance Court.

The goal of this thesis was to evaluate the problems related to the implementation of the two-member panel of judges and to create implementation instructions. The goal of the theory was to introduce the reader to the present situation.

The most important methods used in this thesis include an inquiry and interviews of the employees of the Insurance Court. Other methods include studying laws and other material relating to the subject of the thesis.

The main conclusion of this thesis was that the two-member panel of judges is important in improving the organisation of the Insurance Court and its implementation can be easily carried out using the guidelines included in the thesis. In the future it could be interesting to research how the two-member panel of judges has affected the times of hearing in the Insurance Court and whether there have been any problems related to it.
