Tiivistelmä
Ulosotto on pakkotäytäntöönpanoa, jossa ulosottoviranomaisen avulla pannaan suoritusvelvoite täytäntöön. Yleisin ulosottotoimenpide on palkan tai muun toistuvaistulon ulosmittaus, josta lähetetään maksukiellon saajalle maksukielto. Maksukiellossa on määräykset siitä, miten maksukieltoa tulee toteuttaa. Maksukieltojen noudattamisissa esiintyy ongelmia ja puutteita. Nämä ongelmat vaikuttavat velallisen oikeuksiin saa-da vapaakuukausia ja taulukkomaksuvapautuksia.
Opinnäytetyössä selvitettiin, minkälaisia ongelmia maksukieltojen noudattamisessa esiintyy ja millä tavalla nämä ongelmat vaikuttavat velallisen oikeuteen saada vapaakuukausia ja taulukkomaksuvapautuksia. Aiheeseen perehdyttiin velvoittavien oikeuslähteiden sekä oikeuskirjallisuuden kautta. Työ toteutettiin kvalitatiivisella menetelmällä. Tutkittavan teorian lisäksi aiheesta keskusteltiin kahden kihlakunnanvoudin ja hallintovoudin kanssa, perehdyttiin tilastoihin sekä ylitarkastajille suoritettuun kyselyyn. Empiriassa hyödynnettiin työelämän mukana tuomaa kokemusta, sekä havainnointia kirjoittajan omista työtehtävistä Ulosottovirastossa.
Palkan ja muun toistuvaistulon ulosmittauksesta säädetään ulosottokaaressa ja laissa on säännös maksukieltojen seurannasta. Laki velvoittaa maksukiellon saajaa noudattamaan maksukieltoa ja antaa ulosottoviranomaiselle oikeuden periä maksukiellon noudattamattomuudesta johtuvia puuttuvia suorituksia. Opinnäytetyön loppupäätelmänä on se, että velallisella tulisi olla oikeus vapaakuukausiin ja taulukkomaksuvapautuksiin myös tilanteissa missä maksukieltoa ei noudateta. Kyselyn alhaisen vastausmäärän takia, saatuja tuloksia ei voida yleistää koskemaan koko Ulosottolaitosta. The function of National Enforcement Authority is to enforce performance obligations. Garnishment of the employee pay, or other recurring income is the most com-mon enforcement measure. The employer will receive a withholding notice on how the garnishment should be implemented. There are problems and shortcomings in the observance of withholding notices. These problems affect the debtor's rights to receive payment-free months and scheduled fee exemptions.
The thesis explored what types of problems exist in observance of withholding notices and in what way these problems affect the debtor's right to receive payment-free months and scheduled fee exemptions. The subject was accessed through obliging le-gal sources as well as legal literature. Qualitative research was used in carrying out work. In addition to the theory being studied, there were discussions with two district bailiffs and one administrative bailiff, familiarized with statistics and a survey con-ducted for senior enforcement officers. Empiric drew upon the experience of working life, as well as observation of the author's own work on the National Enforcement Authority.
Garnishment of salary and other recurrent income is provided for in the enforcement code and the law has a provision for monitoring of withholding notices. The law obliges the recipient of the withholding notice to comply with it and gives the bailiff authority the right to recover missing performance resulting from non-compliance with the withholding notice. The conclusion of the thesis is that the debtor should be entitled to payment-free months and scheduled fee exemptions even in situations where the withholding notice is not enforced. The low response rate of the survey direct to that the results cannot be generalized to the entire National Enforcement Authority.
