Tiivistelmä
Opinnäytetyön tarkoituksena on kuvata sidosryhmien eri työvaiheita ja kartoittaa mahdollisia ongelmakohtia esitutkintaprosessin aikana. Lapsen pahoinpitelyn tutkiminen on moniviranomaisyhteistyötä. Jokaisella sidosryhmällä on oma tehtävänsä prosessissa. Terveydenhuollon tehtävänä on tutkia lapselle aiheutuneet vammat, sosiaalitoimi vastaa lapsen turvallisista kasvuolosuhteista, poliisi tutkii rikoksen ja syyttäjä saattaa asian tuomioistuimeen. Kuitenkin näiden neljän sidosryhmän yhteistyössä on havaittu puutteita, eivätkä kaikki sidosryhmät tiedä, mitä toisen työnkuvaan kuuluu.
Opinnäytetyössä tuodaan näkyväksi niitä työvaiheita, mitä eri viranomaisten työtehtäviin kuuluu tapauksen aikana. Prosessin lopputuotoksena syntyy esitutkintapöytäkirja, jonka pohjalta syyttäjä tekee syyteharkinnan. Laadukas esitutkintatyö ja toimiva prosessi sidosryhmien välillä on kaikkien viranomaisten etu.
Tutkimus suoritettiin laadullisena tutkimuksena. Tutkimusta varten haastateltiin jokaisen sidostyhmän edustajia. Vastaukset kirjattiin opinnäytetyöhön ja vastausten perusteella tehtiin toimenpide-ehdotuksia poliisin esitutkintaprosessiin. Opinnäytetyössä tuotiin esille myös ongelmakohtia, joihin sidosryhmien puolelta kaivattiin parannusta.
Tuloksista kävi ilmi, että kaikki sidosryhmän edustajat pitivät alle 1-vuotiaisiin kohdistuvia tapauksia henkisesti raskaina. Jokainen sidosryhmä toi esille, etteivät tarkalleen tiedä muiden viranomaisten työvaiheista. Viranomaispalaverit koettiin tärkeiksi ja niistä haluttaan pitää kiinni. Lisäksi sosiaalitoimen salassapitosäännökset sekä asiakirjojen välittäminen hidastavat prosessin sujuvuutta, johon toivottiin muutosta.
Lääkärit toivoivat palautetta lääkärinlausuntojen sisällöistä sekä tuomioista kaivataan tietoa. Tapausten kuormittavuus ja kokemattomuus poliisin näkökulmasta koettiin hankaloittavan prosessin sujuvuutta. Investigating child abuse is a multi-authority collaboration. Each stakeholder has an important role in the process. The task of health care is to investigate the injuries caused to the child, the social work is responsible for the child's safe growing conditions, the police investigates the crime and the prosecutor takes the matter to court. However, shortcomings have been identified in the co-operation of these four stakeholders and not all stakeholders knows what other stakeholders do in the process.
The purpose of the thesis is to describe the different stages of the stakeholders' work and to bring out possible problem areas during the pre-investigation process. This thesis describes the tasks of different authorities during the case. The final output of the process is a preliminary investigation report, on the basis of which the prosecutor makes a prosecution assessment. Well made pre-trial work and a well-functioning process between stakeholders is in the interest of all authorities.
The study was conducted as a qualitative study. Representatives of each stakeholder were interviewed for the study. The answers were recorded in this thesis and based on the answers, proposals for action were made in the police pre-trial investigation process. The thesis also highlighted problem areas that needed improvement from the stakeholders.
The results showed that all stakeholders considered cases involving children under 1 year of age to be mentally difficult. Each stakeholder pointed out that they did not know exactly about the work steps of other authorities. The official meetings were considered important and the meetings wanted to be permanent. In addition, the secrecy provisions for social work and the transmission of documents will slow down the process, which was called for to change.
The doctors wanted feedback on the contents of the medical statements as well as the judgments needed information. The workload and inexperience of the cases from the police side was perceived as complicating the smooth running of the process.
