Potilaan oikeudet ja niiden rajoittaminen : Sovellusohje päivystyspoliklinikalle

Abstract

Tämän toiminnallisen opinnäytetyön tarkoituksena on tuottaa sovellusohje potilaan oikeuksista ja niiden rajoittamisesta päivystyspoliklinikan henkilökunnan käyttöön. Opinnäytetyön tavoitteena on tarjota henkilökunnalle ajantasaista ja perusteltua tietoa potilaan oikeuksista ja siitä, kuinka niitä voidaan tarvittaessa rajoittaa. Ohjeen tavoitteena on myös parantaa henkilökunnan ja potilaan oikeusturvaa. Opinnäytetyö koostuu kahdesta osuudesta – teoreettisesta taustatiedosta ja tuotekehittelystä.

Potilaan itsemääräämisoikeus on erittäin keskeinen arvo hoitotyössä. Tämän oikeuden rajoittaminen tulisi olla aina tarkasti harkittua ja perusteltua. Rajoittamis- ja eristämistilanteissa ja niiden perusteissa ei tulisi olla tulkinnanvaraa, minkä vuoksi koemme selkeän ohjeistuksen olevan erityisen tarpeellinen päivystyspoliklinikalle, jossa tilanteet voivat olla yllättäviä ja työtahti kiireinen.

Opinnäytetyön tuloksena on kaksi tuotetta, jotka ovat Potilaan oikeudet ja niiden rajoittaminen päivystyspoliklinikalla -sovellusohje sekä Potilaan eristäminen -muistilista. Sovellusohje on kolmen sivun mittainen tiivis kirjallinen ohjeistus potilaan oikeuksiin ja niiden rajoittamiseen liittyvistä keskeisimmistä seikoista. Muistilistaan on tiivistetty kaikki oleellinen tieto eristämiseen liittyen. Muistilistaa voidaan käyttää taskuun taitettavana versiona tai seinälle kiinnitettävänä laminoituna versiona.

Tuotteet on koottu perehtymällä aiheeseen kirjallisuuden, tutkimusten, lakien sekä asiantuntijahaastatteluiden kautta. Haasteenamme oli aiemman täysin aihettamme vastaavan aiemman tiedon puuttuminen. Keskeisiksi asioiksi nousivat selkeiden lakisäädösten puuttuminen päivystyspoliklinikalla sekä rajoittamistilanteiden ennaltaehkäisyn merkitys. Sovellusohjeen kehittelyssä hyödynsimme Jämsän & Mannisen tuotekehittelyprosessin vaiheita sekä asiantuntijahaastatteluista saamiamme tietoja ja ajatuksia.

The purpose of this functional thesis was to produce a guideline of patient rights and restriction of the rights for the emergency department personnel. The aim of the thesis was to offer the personnel up-to-date and justifiable information about patient rights and how to restrict those rights if necessary. Another aim of the thesis was to improve the legal protection of both personnel and patients. The thesis consists of two parts – theoretical background information and product development.

The right of a patient’s self-determination is an extremely essential value in nursing. Restricting this right should always be carefully considered and justified. In the situation of restricting or secluding the patient there should be no room for interpretation, which is why we consider an accurate guideline necessary for the emergency department where situations can happen unexpectedly and working pace can be fast.

As a result of this thesis are two products, which are Patient rights and restricting of the rights in the emergency department – a guideline and Physically restricting the patient – a checklist. The guideline is a three page compact written instruction about the most essential matters related to patient rights and restriction of those rights. The checklist has all the relevant information about physical restriction compressed. The checklist can be used as a foldable and pocket size version or as a laminated version that can be pinned to the wall.

We have created the products by familiarizing ourselves with the subject through literature, researches, laws, and by interviewing experts. One of the challenges we had was the lack of previous researches that would exactly correspond with our subject. The lack of proper laws and regulations in the emergency department and the importance of preventing restriction situations stood out as the essential subjects. With developing the guideline we used the steps of product development by Jämsä & Manninen and the information and thoughts we got from interviewing the experts.
