Lapsen oikeudet huostaanottotilanteessa

Abstract

Työssäni käsitellään lastensuojelua ja huostaanottoa sekä perehdytään lapsen oikeuksiin huostaanottotilanteessa ja huostaanoton aikana. Tarkoituksenani on myös tuoda esille, mihin lapsen oikeudet perustuvat sekä miten oikeuksien toteutumista valvotaan.

Huostaanotoista ja lastensuojelusta puhutaan paljon julkisuudessa. Uutisista voi usein lukea huostaanottojen runsaasta kasvusta ja lastensuojeluilmoitusten suuresta määrästä. Lapsen oikeudet lastensuojelu- ja huostaanottotilanteessa jäävät usein taka-alalle ja siksi työssäni syvennytään erityisesti lapsen oikeuksiin.

Lapsella on oikeus erityiseen suojeluun ja turvalliseen kasvuympäristöön. Jos vanhemmat eivät pysty turvaamaan lapsen oikeuksia, on yhteiskunnalla velvollisuus puuttua tilanteeseen. Opinnäytetyössäni perehdytään lastensuojelun toimiin, joilla turvataan lapsen oikeuksien toteutuminen. Huostaanotolla on suuri vaikutus lapsen elämään, minkä takia lapsen oikeudet ja etu ovat tärkeässä asemassa huostaanottotilanteessa.

This thesis discusses child welfare and child custody with a special focus on the rights of the child in custody situations. Another aim of this thesis is to study where the rights of the child derive from and how those rights are supervised.

Child custody and welfare are common topics in public discussion. News often report on the increase of child custody cases and child welfare notifications. In such situations the rights of the child are often overlooked. That is the reason why this study is especially concerned with the rights of the child.

Every child has the right to special protection and a safe living environment. If parents are unable to protect the child, the society has to intervene. The thesis also discusses child protection measures that ensure the full realisation of rights. If children are taken into custody, it affects their lives very much. That is the reason why it is important to consider the right and interests of the child in child custody arrangements.
