Tiivistelmä
Opinnäytetyössä käsiteltiin yleistä edunvalvontaa sekä edunvalvontavaltuutusta. Aihetta lähestyttiin ikääntyneen henkilön näkökulmasta sekä myös siltä kannalta mitä omaisen tulee ottaa huomioon. Ikääntyneiden edunvalvonnan tarve kasvaa Suomessa jatkuvasti. Holhoustoimilaissa (442/1999) säädetään edunvalvojan tehtävistä. Työssä perehdyttiin holhoustoimilain säännöksiin sekä myös muihin lakeihin, joissa säädetään edunvalvontaan liittyvistä asioista. Työssä käytiin läpi edunvalvontaa sekä edunvalvontavaltuutusta ja niiden eroja käytännössä.
Ihminen, joka on iäkäs tai vaikeasti sairas, voi olla heikentyneen toimintakykynsä takia kykenemätön huolehtimaan omista asioistaan tai ajamaan omaa etuaan, tällöin edunvalvoja voi olla tarpeen. Syitä edunvalvonnan tarpeellisuuteen on monia, mutta yleisimmät syyt ovat korkea ikä tai vaikea sairaus. Holhoustoimilaki asettaa tiettyjä velvoitteita ja rajoituksia, joiden puitteissa edunvalvojat tekevät työtään. Toimintaa valvoo Digi- ja väestötietovirastot. Edunvalvojat ovat velvollisia vuositilien muodossa esittämään, miten päämiesten asioita on hoidettu Digi- ja väestötietovirastolle.
Edunvalvontavaltuutuksen tarpeeseen on myös hyvä varautua mahdollisimman ajoissa. Edunvalvontavaltuutuslaissa (648/2007) säädetään edunvalvontavaltuutuksesta. Jos henkilöllä on vahvistettu edunvalvontavaltuutus ja sen avulla asiat hoituvat asianmukaisesti, holhoustoimilain mukaiselle edunvalvonnalle ei ole tarvetta. Edunvalvontavaltuutuksen avulla on mahdollista varautua etukäteen asioiden hoidon sujumisen varalta, jos henkilö sitä tulee tarvitsemaan eikä pysty enää huolehtimaan asioistaan.
Kyseessä on toiminnallinen opinnäytetyö, jossa on sovellettu lainopin eli oikeusdogmatiikan menetelmiä. Ensisijaisena lähteenä olivat lait sekä oikeuskirjallisuus. Työssä on myös liitteenä helppolukuinen ja selkeä opaslehtinen. Opaslehtisestä tehtiin hyödyllinen ja käytännönläheinen kokonaisuus. The thesis dealt with the public guardianship and the power of attorney for guardianship. These issues were approached from the perspective of elderly people. In addition, it was clarified what the relative should take into account when considering the guardianship of a close relative. The need for guardianship is constantly growing in Finland. The Guardianship Act (442/1999) provides the duties for a trustee. In this thesis the regulations of the Guardianship Act and other laws that regulate matters related to Guardianship were also examined. The practical difference of the public guardianship and the power of the attorney for guardianship were reviewed.
A person who is elderly or seriously ill may be unable to take care of their own interests due to their reduced ability to function, in which case a guardian may be necessary. There are many reasons for the need of guardianship, but the most common are high age or illness. The Guardianship Act imposes certain types of obligations and restrictions in which trustees perform their work. The supervisory body is the Digital and population data services agency, to which the trustees are obligated to present in form of annual accounts on how the affairs of the principals have been handled.
It is also a good idea to prepare for the need of the power of attorney for guardianship as early as possible. The Guardianship Authorization Act (648/2007) provides for Guardianship authorization. If a person has a confirmed power of attorney for guardianship and matters are handled properly within this case, there is no need for guardianship in accordance with the Guardianship Act. With the help of a power of attorney for guardianship, it is possible to prepare in advance for the handling of things, if the person will need it and is no longer able to take care of their affairs.
It is a functional thesis in which the methods of jurisprudence i.e. legal dogmatics have been applied. The primary sources were laws and legal literature. The work is also accompanied by an easy-to-read and clear guide. The guide was made written as a useful and practical whole.
