Suomen valtion velvollisuus suojella läheisväkivaltarikoksen uhria

Abstract

Suomen valtion velvollisuutena on taata riittävät lainsäädännölliset keinot, joilla henkeen ja terveyteen kohdistuvia läheisväkivaltarikoksia kyetään tehokkaasti ennalta estämään. Suomen valtion on myös kyettävä konkreettisesti huolehtimaan väkivaltaa kokeneiden tai väkivallan uhan alla elävien kansalaisten turvallisuudesta. Rikostorjunnan ohella uhrien suojelemiseksi tarvitaan toimivia tukipalvelurakenteita. Sekä uhri että tekijä voivat hyötyä hyvin organisoidusta asiantuntijaverkostosta, joka tekee työtä läheisväkivallan vähentämiseksi.

Tämä Suomen oikeusministeriön tilaama opinnäytetyö on tarkoitettu ministeriöiden ja eri turvallisuusviranomaisten tarpeisiin kehitettäessä läheisväkivallan uhrien suojelukeinoja. Siinä on selvitetty Suomen 11 poliisilaitokseen suunnatun kyselytutkimuksen avulla poliisiviranomaisen kokemuksia lähestymiskieltojen käytettävyydestä ja tehokkuudesta. Lisäksi on kartoitettu poliisin kehittämisideoita uhriturvallisuuden parantamiseksi. Työn tekeminen on ollut perusteltua ja tarpeellista, koska Suomessa ei ole selvitetty aiemmin poliisipäällystön kokemuksia asiasta.

Opinnäytetyö on kvalitatiivisin tutkimusmenetelmin toteutettu tutkielma. Suomen valtion velvollisuutta suojella läheisväkivallan uhria on lähestytty kahden pääteeman kautta, jotka ovat läheisväkivallan uhria suojaava lainsäädäntö Suomessa sekä lähestymiskielto ja muut läheisväkivallan uhria suojaavat keinot. Tietoperustana on käytetty kirjallisuuskatsausta ja kyselyä. Tiedon analysointimenetelminä ovat toimineet aineistolähtöinen analyysi ja tee-moittelu.

Poliisille tehty kyselytutkimus on vahvistanut näkemystä jo käytössä olevien keinojen tar-peellisuudesta. Poliisitoiminnan painotus on ollut asiakasneuvonnassa ja palveluohjauksessa, rikosten ennalta estämisessä, pakkokeinovalikoiman käytössä sekä verkostoyhteistyössä. Poliisin uhriturvallisuutta koskevat kehitysehdotukset on jo pyritty huomioimaan nykyisessä lainsäädännössä, lukuun ottamatta lähestymiskiellon sähköistä valvontaa.

Opinnäytetyön tulosten perusteella lainsäädännön nykyinen riittävyys suhteessa lähestymiskiellon tehokkuuteen ja vaikuttavuuteen on kyseenalaistunut. Lainsäädäntömuutostarpeita silmällä pitäen on kerättävä lisää tutkimustietoa sekä kartoitettava lähestymiskieltomenettelyn ja sen sähköisen valvonnan käyttöön liittyviä ongelmia jatkokehittämistarpeineen. Lainsäätäjän, läheisväkivallan uhrien sekä vastuuviranomaisten näkemykset on mahdollisuuksien mukaan kartoitettava ja tehtävä yhteiskunnallisesti läpinäkyviksi.

It is the responsibility of the State of Finland to ensure adequate legislative means to effectively prevent domestic and health-related violent crimes. The Finnish state must also be able to concretely ensure the safety of citizens, who have experienced or are at risk of violence. In addition to crime prevention, there is a need for effective support structures to protect victims. Both the victim and the perpetrator can benefit from a well-organized co-operation of experts working to reduce domestic violence.

This thesis, commissioned by the Finnish Ministry of Justice, is designed to meet the needs of ministries and various security authorities in developing ways to protect victims of domestic violence. It presents the police authorities' experience of the usability and effectiveness of restraining orders. The survey has focused on 11 Finnish police departments. In addition, development ideas for the police forces to improve victim safety have been mapped. It has been justified and necessary to carry out the work, as the experience of the police officers in the matter has not been previously studied in Finland.

This thesis has been implemented using qualitative research methods. The Finnish State's obligation to protect the victim of domestic violence has been approached through two main themes, from which the first is the legislation protecting the victim of domestic violence in Finland. The second theme is the restraining order and other means of protecting the victim of domestic violence. The theoretical framework is based on a literature review and a questionnaire. The Data were analysed thematically.

The survey, which was answered by the police, reflects the current perception of the need for the means already in place. The focus of police activities has been on customer counselling and service guidance, crime prevention, coercive measures and cooperation between authorities. The police proposals for improving victim safety have already been considered in existing legislation, except electronic monitoring of the restraining order.

Based on the results of the thesis, the current adequacy of the legislation in relation to the effectiveness and efficiency of the restraining order has been questioned. Further research is needed to determine the need for legislative changes. Problems related to the use of the restraining order and its electronic monitoring need to be identified. It is also necessary to evaluate whether there are other substantive needs for further development. The views of the legislator, the victims of domestic violence and responsible authorities should, when possible, be mapped and made socially transparent.
