Elinkeinovapaus ja sen rajoittaminen

Abstract

Opinnäytetyön ydinsisällön muodostavat elinkeinovapauden perusoikeus, sen rajoitusedellytykset ja edellytyksiä soveltaen toteutetut rajoitukset. Työssä selvitettiin elinkeinovapauden oikeudellinen perusta ja keskeinen sisältö, elinkeinonharjoittamisen oikeutta määrittävän ja rajoittavan sääntelyn pääpiirteet ja elinkeinovapauden rajoittamisessa sovellettavat rajoitusopit. Näiden pohjustamana koottiin yhteen elinkeinovapauden keskeisimmän rajoituksen, luvanvaraisuuden, piiriin kuuluvia elinkeinoja. Näistä yksitellen pääkohdittain selvitettiin luvan myöntävä viranomainen, luvan myöntämisen edellytykset ja lupavelvoitteen perustamisen taustasyyt.

Tutkimuksen aihevalintaan johti tutkimuksen tekijän omien tiedollisten päämäärien lisäksi se seikka, että elinkeino-oikeutta käsitteleviä ammattikorkeakoulujen opinnäytetöitä on tehty verrattain vähän. Työ on lainopillinen kirjoituspöytätutkimus, jossa oikeuslähteiden avulla selvitetään, mikä on voimassa olevan oikeuden sisällön antama vastaus tutkimusongelmiin.

Elinkeinovapaus on perustuslaissa vahvistettu perusoikeus ja pääsääntö, jonka rajoittaminen on poikkeuksellisesti mahdollista yhteiskunnallisesti painavista ja perusoikeusjärjestelmän kannalta hyväksyttävistä syistä. Rajoittamisessa tulee sovellettavaksi perustuslakivaliokunnan käytännössä vakiintuneet perusoikeuksien yleiset rajoitusedellytykset ja niiden kautta muotoutuneet elinkeinovapauden rajoitusopit. Lainvalmistelussa luvanvaraisuutta on luonnehdittu ongelmallisimmaksi elinkeinovapauden rajoitukseksi, minkä johdosta sitä on pyritty vähentämään. Yhteiskunnallisen tarpeen asettama paine on kuitenkin sellainen, että se saa aikaan tutkimuksen mukaisen useita kymmeniä luvanvaraisia elinkeinoja kattavan listan.

The core content of this thesis is formed by the basic right of business freedom, the prerequisites for its restriction and the restrictions realized through the application of those prerequisites. The study comprises the legal foundation and essential content of business freedom, the main features of defining and restrictive regulation of business freedom and the restriction doctrine applied to business freedom restriction procedures. Those set up the way for the final step which was gathering together cases under the sphere of the most relevant restriction of business freedom – licensed trades. Then the goal was to find out trade by trade the licensing authority, licensing conditions and reasons for the establishment of the license system.

In addition to the researcher’s own interests, choosing the topic for the thesis was also affected by the fact that there have been relatively few studies from the field of trade law among polytechnic theses. The study is a juridical research, whose function is with the help of the legal sources to find out what the answer is that the laws in effect give to the research problems.

Business freedom is a constitutional basic right and a principal rule, whose restriction is possible only in exceptional circumstances for strong social and constitutionally acceptable reasons. A restriction must be performed by applying basic rights’ general restriction prerequisites and the restriction doctrines of business freedom formed through them that have been established in practice by the Committee for Constitutional Law. Law drafting has characterized trade licensing as the most problematic restriction of trade, which is why there has been an attempt to reduce it in recent years. However, the pressure set by social need is strong enough to cause a list of several dozen licensed trades as featured in this thesis.
