Tiivistelmä
Maailman laajuinen COVID-19 pandemia mullisti kaiken muun mukana myös työelämää. Digitalisaatio eteni sen seurauksena merkittävästi, osa työntekijöistä siirtyi etätyöhön, mutta myös monella työn tekeminen edellytti edelleen fyysistä läsnäoloa ja ihmiskontakteja. Monet lähityötä tekevät joutuivatkin työnsä fyysisen läsnäolon vuoksi altistamaan itsensä suuremmille terveysriskeille.
Tämän opinnäytetyön tavoitteena oli tutkia hengityksensuojaimen eli maskin käyttöä suhteessa lainsäädäntöön työnantajan ja työntekijän näkökulmasta sekä miten se huomioidaan työturvallisuuden näkökulmasta. Tutkimuksen tavoitteena oli selvittää, pystytäänkö työturvallisuuslainsäädännön kautta mahdollistamaan turvallinen työympäristö COVID-19 pandemia kaltaisessa tilanteessa, vai onko lainsäädännön soveltamisessa sekä tulkinnassa puutteita ja miten ne ilmenevät. Onko voimassa oleva lainsäädäntö riittävä takaamaan käytännössä terveysturvallisen työympäristön COVID-19 kaltaisen yleisvaarallisen tartuntataudin vallitessa?
Opinnäytetyö on luonteeltaan oikeuspoliittinen tutkimus, jossa lähestytään tutkimuskysymystä ja sen tavoitteita oikeudellisesta näkökulmasta ja tarkastellaan tutkimuskysymystä voimassa olevan lainsäädännön ja voimassa olevien oikeusnormien kautta. Opinnäytetyön keskeisimpinä lähteinä käytettiin tutkimuskysymyksen aihealueeseen liittyvää lainsäädäntöä ja lainvalmisteluasiakirjoja sekä alan kirjallisuutta ja artikkeleja.
Varmoja johtopäätöksiä tehtyjen tutkimusten perusteella ei voida tehdä, mutta tulokset viittaavat siihen, että yksilön oikeudet pidättäytyä maskin käytöstä, ovat heikentäneet erityisesti lähityötä tekevien työllisten terveysturvallisuutta ja lisänneet tältä osin myös työn henkisiä kuormitustekijöitä. Lienee osin myös niin, että työnantajilla ei ole ollut vallitsevassa tilanteessa ja lainsäädännön tukemana riittäviä edellytyksiä taata lähityötä tekeville työntekijöille mahdollisuutta tehdä valitsemaansa työtä terveysturvallisesti. The worldwide COVID-19 pandemic revolutionized working life in addition to everything else. Digitization accelerated, and many employees transitioned to remote work, but many positions and duties still required physical presence and human contacts. Many employees who worked closely with other people had to expose themselves to greater health risks.
The aim of this thesis was to investigate the use of respirators or masks in relation to legislation from the employer's and employee's point of view and how it is considered from the perspective of occupational safety. The objective of the study was to discover whether it is possible to enable a safe working environment through occupational safety legislation in a situation such as the COVID-19 pandemic or whether there are shortcomings in the application and interpretation of the legislation and how they are manifested. Moreover, the study aimed to investigate whether the legislation is sufficient to guarantee a health-safe work environment when a universally dangerous infectious disease such as COVID-19 prevails.
The study method of this thesis is legal policy research, where the research question and its goals are approached from a legal perspective, and the research question is examined through valid legislation and legal norms. The main sources of the thesis were the legislation and law drafting documents related to the subject area of the research question, as well as literature and articles in the field.
It is not possible to draw definite conclusions based on the conducted studies; however, the results suggest that the individual's right to refrain from wearing a mask has weakened the health safety of employees whose duties require in-office work. Consequently, mental stress factors have also increased. Furthermore, it can be presumed that, in the prevailing situation and in terms of current legislation, employers have not been able to guarantee the employees performing in-office work the opportunity to work in a health-safe manner.
