Ennen lapsen syntymää tunnustettujen vanhemmuuksien vahvistamisprosessi vanhemmuuslain mukaan

Abstract

Tämän opinnäytetyön tilaajana toimi Digi- ja väestötietovirasto. Viraston yksi lakisääteisistä tehtävistä on väestötietojärjestelmän ylläpito ja vanhemmuuden vahvistaminen on yksi siihen liittyvä tehtävä. Avioliiton ulkopuolella syntyneillä lapsilla on syntyessään ainoastaan yksi vanhempi ja huoltaja, synnyttänyt äiti. Jotta lapselle saadaan toinen vanhempi, on vanhemmuus tunnustettava ja vahvistettava väestötietojärjestelmään. Vanhemmuuden vahvistamisen myötä lapselle vahvistetaan toinen juridinen vanhempi. Sujuva ja nopea vanhemmuuden vahvistaminen on tärkeää lapsiperheiden kannalta.

Tutkimuksen tavoitteena oli luoda ohje Digi- ja väestötietoviraston käsittelyjärjestelmään sekä selvittää, miten vanhemmuuslaki muutti ennakollisten vanhemmuuden tunnustamisten prosessia. Opinnäytetyön tuloksena valmistui ohje Digi- ja väestötietoviraston käyttöjärjestelmään.

Opinnäytetyön teoreettisessa viitekehyksessä avattiin vanhemmuuslain, digitalisaation sekä prosessiajattelun käsitteet. Vanhemmuuslaki ja sen vaikutus käsittelyprosessiin on tutkimuksen keskeinen teema. Opinnäytetyön lähestymistapana on konstruktiivinen tutkimus. Opinnäytetyössä kerättiin tietoa laadullisen tutkimuksen keinoin, haastattelulla, havainnoinnilla sekä blueprint-menetelmän avulla.

Tutkimuksessa saatujen tulosten perusteella voitiin tulkita lakimuutoksen sekä digitalisaation tuomien muutosten vaikutukset vanhemmuuden vahvistamisen prosessiin. Lakimuutoksen vaikutuksia käytäntöön selvitettiin Digi- ja väestö-tietoviraston henkilöstöä haastattelemalla. Opinnäytetyön tuloksena valmistui Digi- ja väestötietoviraston käsittelyjärjestelmään ohje, joka on testattu yhdessä henkilöstön kanssa kevään 2023 aikana. Ohje on luovutettu viraston käyttöön kesäkuussa 2023.

This thesis was commissioned by the Digital and Population Data Services Agency. One of the statutory tasks of the agency is the maintenance of the population information system, and the confirmation of parenthood is one of the related tasks. The birth mother is the only parent and guardian of a child born outside of marriage. For the child to have another parent, the parenthood must be acknowledged and confirmed to the population information system. With the confirmation of parenthood, another legal parent is confirmed for the child. Smooth and fast confirmation of parenthood is important for families with children.

The goal of the study was to create a guide for the processing system of the Digital and Population Data Services Agency and to find out how the Parenthood Act changed the process of acknowledgement of parenthood before the birth of a child. As a result of the thesis, the guide was completed for the processing system of the Digital and Population Data Services Agency.

In the theoretical framework of the thesis, the concepts of Parenthood Act, digitalization and process thinking were opened. The Parenthood Act and its effect on the handling process is the central theme of the research. The approach of the thesis is constructive research. In the thesis, information was collected by means of qualitative research, interview, observation, and the blueprint method.

Based on the results obtained in the study, it was possible to interpret the effects of the law change and digitalization on the process of confirming parenthood. The effects of the law change on practice were investigated by interviewing the staff of the Digital and Population Data Services Agency. As a result of the thesis, a guide was completed for the processing system of the Digital and Population Data Services Agency, which has been tested together with the personnel during the spring of 2023. The guide has been handed over to the agency in June 2023.
