Markkinavuoropuhelun merkitys julkisissa hankinnoissa

Abstract

Opinnäytetyön tarkoitus oli tarkastella markkinavuoropuhelun merkitystä julkisissa hankinnoissa. Opinnäytetyön toimeksiantajan tavoitteena on edistää julkisten hankintojen kehittämistä, mikä on ilmennyt erityisesti pyrkimyksenä lisätä vuorovaikutusta markkinoiden kanssa markkinavuoropuhelun keinoin. Markkinavuoropuhelu ei ole pelkkä valmisteluvaihe, vaan strateginen työkalu, joka parantaa tarjouspyyntöjen laatua, vähentää keskeytyksiä ja lisää avoimuutta. Hankintayksiköille se tarjoaa mahdollisuuden tarkentaa tarpeita ja vähentää valitusriskiä, kun taas palveluntuottajille se luo tilaisuuden vaikuttaa hankinnan sisältöön ja valmistautua kilpailutukseen.

Opinnäytetyön toteuttaminen oli ajankohtaista paitsi toimeksiantajan tarpeiden vuoksi, myös julkisia hankintoja koskevien muutosten vuoksi. Hankintalakiin on parhaillaan tulossa uudistuksia, joiden valmistelu oli käynnissä opinnäytetyön kirjoittamisen aikana. Hankintalain uudistus etenee siten, että hallituksen esitys on annettu eduskunnalle syysistuntokaudella 2025, ja lain on tarkoitus tulla voimaan 1. tammikuuta 2026.

Tutkimus toteutettiin laadullisena kyselytutkimuksena. Menetelmä mahdollisti kokemusten ja näkemysten keräämisen joustavasti, ja aineisto analysoitiin sisällönanalyysin avulla tunnistaen keskeiset teemat. Tulokset korostavat vuoropuhelun merkitystä etenkin hankintaprosessin alkuvaiheessa. Haasteena on varmistaa aidosti vuorovaikutteinen ja vaikuttava vuoropuhelu.

The purpose of thesis was to examine the significance of market dialogue in public procurement. The commissioning organization aims to promote the development of public procurement, which has been particularly evident in its efforts to increase interaction with the market through market dialogue. Market dialogue is not merely a preparatory phase but a strategic tool that improves the quality of tender documents, reduces cancellations, and enhances transparency. For contracting authorities, it provides an opportunity to clarify requirements and reduce the risk of appeals, while for service providers, it creates a chance to influence the content of the procurement and prepare for the tendering process.

The implementation of thesis was timely not only due to the needs of the commissioning organization but also because of ongoing changes in public procurement. Amendments to the Public Procurement Act are currently underway, and their preparation was in progress during the writing of this thesis. The reform of the Act is proceeding so that the government’s proposal was submitted to Parliament during the autumn session of 2025, and the new legislative amendments are scheduled to enter into force on 1 January 2026.

The research was conducted as a qualitative survey. This method enabled the flexible collection of experiences and perspectives, and the data was analyzed using content analysis to identify key themes. The results emphasize the importance of dialogue, particularly in the early stages of the procurement process. The main challenge is to ensure genuinely inter-active and impactful dialogue.
