Tiivistelmä
Opinnäytetyön tavoitteena oli tehdä MPV-Infrarakenne Oy:lle uudet urakkasopimuspohjat käytettäviksi sillankorjaushankkeen aliurakoihin. Sopimus tulee tehdä aina ennen rakennushankkeen aloitusta. Sopimuksien avulla pystytään vähentämään hankkeisiin liittyviä häiriö- ja ristiriitatilanteita sekä niistä aiheutuvia aikataulumuutoksia, kustannuksia ja ylimääräisiä työtunteja. Erityisesti aliurakkasopimusten yhteensovittaminen urakkasopimuksen kanssa on tärkeää, jotta pääurakoitsija välttyy turhilta kuluilta.
Sopimuspohja ja sen liitteeksi tullut urakkaohjelma tehtiin ammattikirjallisuutta, Rakennusurakan yleisiä sopimusehtoja sekä urakoitsijan vanhoja sopimuspohjia apuna käyttäen. Työssä käytiin läpi yleisten sopimusehtojen taustaa ja soveltamista sopimukseen, sopimuksen syntymisen vaiheet sekä yleisimmät häiriötilanteet hankkeissa.
Opinnäytetyön tuloksena saatiin selkeä sopimuspohja, joka tukee hankkeen onnistumista niin aikataulullisesti kuin laadullisestikin. Tämän seurauksena myös hankkeen kustannukset pienenevät. Sopimus toimii turvana aliurakoitsijoille sekä urakoitsijalle itselleen. Työhön on turvallisempi ryhtyä, kun sen taustalla on selkeä ja kattava sopimus, josta löytyy vastaukset erilaisiin häiriötilanteisiin.
Sopimuspohjaa voidaan hyödyntää jatkossa myös muissa sillankorjauksiin liittyvissä hankkeissa. Samojen sopimuspohjien käyttäminen säästää urakoitsijan omaa aikaa, sillä jokaista hanketta varten ei tarvitse luoda uutta sopimuspohjaa. The aim of this thesis was to make new contract bases for MPV-Infrarakenne Oy to be used for the subcontracting of a bridge repair project. The contract should always be made before the start of the construction project. Agreements can be used to reduce project disruptions and conflicts, as well as the resulting schedule changes, costs and extra working hours. Especially the coordination of subcontracts with the main contract is important in order to avoid unnecessary costs for the main contractor.
The contract template and the contract program were made with the help of professional literature, the general terms and conditions of the Construction Contract and the contractor’s old templates. The background and application of the general terms and conditions to the contract, the stages of the contract and the most common disturbances in the project were examined in the work.
As a result, the thesis achieved a clear contractual basis which supports the success of the project both in terms of schedule and quality. The costs of the project are also reduced. The contract acts as a security for the subcontractors as well as for the contractor himself. It is safer to start work when it is based on a clear and comprehensive agreement that provides answers to various disruptions.
In the future the contract base can be used in other projects related to bridge repairs. Using the same contract templates saves the contractor’s time, as there is no need to create a new contract template for each project.
