Ruotsin kielen asema ja ruotsinkieliset palvelut Ulosottolaitoksessa organisaatiouudistuksen 1.12.2020 jälkeen

Abstract

Työn pääasiallisena tavoitteena oli selvittää miten 1.12.2020 voimaan tullut organisaatiouudistus on vaikuttanut ruotsin kielen asemaan ja ruotsinkielisiin palveluihin Ulosottolaitoksessa.

Opinnäytetyössä perehdyttiin Ulosottolaitokseen, sen toimintaan ja tarkoitukseen, sekä Ulosottolaitoksen rakenneuudistukseen. Opinnäytetyössä tutkittiin ruotsin kielen asemaa Suomessa yleisesti, sekä lainsäädäntöä liittyen ruotsin kielen asemaan ulosottotoiminnassa, lakien esitöitä sekä lakeihin liittyvää oikeuskirjallisuutta.

Tutkimus suoritettiin kvalitatiivisella eli laadullisella menetelmällä. Työ perustui tutkimusaineiston tarkastelemiseen ja päätelmät tehtiin aineistoista ilmenevien seikkojen sekä teemahaastattelun avulla. Organisaatiouudistuksen käytännön toteutusta ruotsin kielen näkökulmasta tutkittiin lisäksi työn toimeksiantajalta saatujen aineistojen ja tiedonantojen avulla, sekä kirjoittajan omista havainnoinneista virkamiehenä Ulosottolaitoksessa.

Opinnäytetyön ydin kiteytyi ulosoton lainsäädännön ja ulosoton organisaatiorakenteiden tutkimiseen ruotsin kielen aseman kannalta. Työn lopussa tuotiin konkreettisesti esiin muutoksen kielelliset vaikutukset asiakaspalvelun ja henkilöstön osalta. Yhteenvedossa esitettiin tutkimuksessa havaitut organisaatiomuutoksen kielioikeudelliset onnistumiset sekä tuotiin esille näkökulmia organisaation tulevaan kehittämiseen kielellisten oikeuksien toteutumisen kannalta. Opinnäytetyön keskeiset johtopäätökset ovat, että ruotsin kielen asema on organisaatiouudistuksessa vahvistunut, ja että kielelliset oikeudet on uudistuksessa pääosin huomioitu.

The main objective of this work was to find out how the organizational reform that was launched on 1 December 2020 has affected the status of the Swedish language and services in Swedish at the National Enforcement Authority Finland.

This study examines the National Enforcement Authority, its statutory duties and purpose, as well as the restructuring of the National Enforcement Authority. The thesis examined the status of the Swedish language in Finland in general, as well as the legislation related to the Swedish language in enforcement activities, preliminary work on laws and legal literature.

The study was conducted using a qualitative method. The work was based on an examination of research material and conclusions were drawn from facts found in the material and from the thematic interview. The practical implementation of the organizational reform from the perspective of the Swedish language was also studied from material and communications received from the client, and upon the author's own observations as an official at the National Enforcement Authority.

The core of this thesis was crystallized in the study of the implementation of the enforcement legislation and the organizational structures of the National Enforcement Authority from the perspective of the Swedish language. The concrete language impacts of the re-organization on customer service and personnel were highlighted. The summary presented the linguistic successes of the re-organization observed in the study, and high-lighted aspects on the National Enforcement Authority’s future developing in terms of linguistic rights. The key conclusions of the thesis were that the status of the Swedish language has been strengthened in the organizational reform, and that linguistic rights have been mainly considered.
