Att mista en närstående släkting är alltid en tung och sorgsen process för individer. Men oberoende av sorgen ska anhöriga arrangera den avlidnes ärenden som kommer efter hens död. För att sköta dödsboets ärenden, vore det till alla parters fördel att bekanta sig grundligt med dödsboets process och vad detta innebär för delägarna i boet. Det är ytterst viktigt att någon av den avlidnes anhöriga omhändertar boet till sin skötsel för att undvika möjliga sanktioner som kan förekomma vid försummelse av boets ärenden.
När en person dör, bildas ett dödsbo till följd av hens bortgång. Förvaltningen och skötseln av boet tillhör dödsboets delägare. Syftet med denna avhandling är en lättförstådd handbok där man beaktar de uppgifter, skyldigheter och rättigheter som en delägare i dödsboet har. Handboken behandlar de aspekter som varje delägare för ett dödsbo torde beakta, dvs. ärenden efter boets uppkomst fram till arvsbeskattningen. Under arbetet fördjupas det inte desto mera i något specifikt område istället genomgås processen generellt.
Avhandlingen bygger på litteratur relaterad till familje- och arvsrätten samt den finska lagstiftningen. Den lag som står för grund till avhandlingen och styr detta är ärvdabalken men även lagen om skatt på arv och gåva samt konkurslagen förekommer mer eller mindre under arbetes förlopp. Losing a relative is always a heavy and sorrowful process for individuals. But regardless grief that may occur, relatives shall arrange the deceased's cases which will occur after the death. In order to manage the estate's affairs, it would be to the benefit of all parties to become thoroughly acquainted with the process of the estate and what this means for the co-owners of the estate. It is extremely important that someone of the deceased's relatives takes care of the estates tasks to in order to avoid possible sanctions that may occur in the event of neglect of the estate's cases.
When a person dies, an estate is formed as a result of the demise of he or she. The management of the estate belongs to the estate's co-owners. The purpose of this thesis is an easy-to-understand manual taking into account the duties, obligations and rights of a co-owner of the estate. The manual deals with the aspects that each co-owner of an estate should take into their consideration, i.e., cases following the emergence of the estate until inheritance taxation. The work focuses on the process in general.
The thesis is based on literature related to family and inheritance law as well as the Finnish law. The law that stands for the basis of the thesis and governs it, is the inheritance law, together with the law on gift tax and the Bankruptcy Act.
