Tiivistelmä
Tutkimusaiheena on poliisin oma-aloitteinen tietojenluovutus ulosottoviranomaiselle. Tutkimusasetelma rakentuu tutkittavana ilmiönä olevan oikeustapauksen varaan. Tut-kimusmetodi on oikeusdogmaattinen eli lainopillinen, tietojenluovutusta tarkastellaan tapaustutkimuksena.
Tutkimuksen kohteena on Lounais-Suomen poliisilaitoksen henkilöstö. Tutkimuksen tarkoituksena on saada mahdollisimman monipuolinen kuva tutkittavasta ilmiöstä tutustumalla siihen kokonaisvaltaisesti. Tutkimuksen tavoitteena on selvittää tapauk-seen vaikuttava oikeusnormisto ja sen mahdollinen muutostarve. Tutkimusongelma on poliisin oma-aloitteisessa tietojenluovuttamisessa ilmennyt lainsäädännöllinen tulkin-nanvaraisuus. Tutkimuksessa on kartoitettu asian nykytila, selvitetty luovuttamisoi-keuden oikeusnormisto sekä tietojenluovuttamisen mahdollistavat ja rajoittavat teki-jät.
Tutkimus on toteutettu hyödyntäen sekä laadullisen että määrällisen tutkimuksen me-netelmiä. Tutkimuksen teoreettinen viitekehys on koottu poliisin tietojenluovuttami-sen oikeusnormiston ympärille. Osuus nojautuu vahvasti oikeustapauksen käsittelyyn eri oikeusasteissa.
Tutkimusaineisto on kerätty kirjallisilla dokumenteilla, kyselylomakkeella ja teema-haastatteluilla poliisiviranomaisilta. Tutkimustuloksista on tehty sisällönanalyysillä johtopäätöksiä ja toimintasuosituksia.
Tutkimuksessa on saatu selville lainsäädännöllisiä tulkinnanvaraisuuksia poliisin oma-aloitteisessa tietojenluovuttamisessa ulosotolle. Viranomaisten kyselystä ja haas-tatteluista on vahvistunut käsitys epäselvyyksistä. Tutkimuksen voidaan katsoa lisää-vän tietämystä ja tuottavan uutta tietoa viranomaisyhteistyön järjestämisestä myös yleisellä tasolla. Tutkimuksen tuloksena on muodostunut selkeä kuva asian lainsää-dännön muutoksen tarpeellisuudesta. Abstract
The topic of the research is the police's independent initiative disclosure of information to the enforcement authority. The research design is based on the court case as a phenomenon. The research method is juridical, and the disclosure of information is considered as a case study.
The subject of the research is the personnel of the Southwest Finland Police Department. The purpose of the study is to get the most diverse picture possible of the phenomenon under study by getting to know it holistically. The aim of the study is to find out the legal regulations affecting the case and its possible need for change. The problem with the research is the legal ambiguity that has emerged in the police's independent initiative disclosure of information. The study has mapped the current state of the matter, clarified the legal norms of the right of disclosure, and the factors that enable and restrict the disclosure of information.
The research has been carried out using the methods of both qualitative and quantitative research. The theoretical framework of the study is gathered around the legal framework for police disclosure. The share relies heavily on the handling of a case in different courts.
The research material has been collected through written documents, a questionnaire and thematic interviews with police authorities. Conclusions and recommendations for action have been made from the research results through content analysis.
The research has revealed legal interpretations in the independent initiative disclosure of information to the enforcement authority. The survey and interviews with the authorities have confirmed the perception of ambiguities. The study can also be considered to increase knowledge and generate new information on the organization of co-operation between authorities. The result of the research has given a clear picture of the need to change the legislation in this area.
