Artificial Intelligence is a set of technologies which are currently changing the landscape of multiple industries at a fast pace. While companies are trying to adapt and adopt these technologies, governments and other ethical and regulatory bodies are trying to catch up with the developments in AI in order to safeguard the rights of their citizens. Recruitment is a core part of a working life in the service-based economy. AI becomes increasingly relevant for recruitment and Talent Acquisition as it promises faster and more accurate candidate selection.
In this work we are analysing the current state of recruitment and Talent Acquisition inside the European Union as the market has increased access to AI-based tools. We find that while the current impact of such technologies is minimal as their official large-scale adoption is lagging behind the hype cycle. Outside technical and subject matter experts the understanding of the capabilities and opportunities of AI tools are notably poor. The legal tender for the use of AI in non-technical areas is non-existent. Currently several regulations are being drafted and before their release data usage and human rights laws form the only framing for AI usage legal guidelines.
We review the existing and future laws and regulations, as well as academic positions on AI, fair and equitable recruitment, non-discrimination human rights, and data privacy. We follow up with gathering confidence data about the understanding and usage of AI-based tools in recruitment from specialists in the industry and interview privacy advocates, AI experts and Talent Acquisition professionals. Analysing the consensus and complimentary opinions, we successfully create a set of guidelines for recruiters on how to approach the use of AI in the current landscape and in the near future, starting with the limitations of the technology and following up with rules that fit the lawful, ethical, and robust description of an AI system.
