Tiivistelmä
I detta arbete redogörs det för beskattningen vid en generationsväxling inom jordbruk. Syftet med lärdomsprovet är att redogöra för hur både överlåtaren och övertagaren kan på förmånligaste vis genomföra en generationsväxling. I lärdomsprovet beskrivs även, hur en generationsväxling i praktiken går till och vad som är viktigt att tänka på. Genom beräkningar fås fram vilket av de tre olika generationsväxlingssätten, köp, gåvoartat köp eller gåva, som är det förmånligaste sättet ur överlåtarens och övertagarens perspektiv vid den generationsväxling inom jordbuk som använts som fallstudie. Förutsättningar och tillvägagångssätten vid generationsväxling stadgas i lagen om stöd för upphörande om att bedriva jordbruk. Därtill har även använts den expertis som fås från Lantbruksföretagarnas pensionsanstalt (LPA), Svenska lantbrukssällskapens förbund (SLF) och Nordea. Österbottens svenska producentförbund r.f. (ÖSP) har även ordnat ett informationstillfälle om generationsväxling inom jordbruk, vilket även bidrog med information till lärdomsprovet. Även internetkällor, som man genom sökorden generationsväxling, avträdelsestöd och jordbruk får fram, har bidragit till att skapa en fullständig bild av problemområdet. Resultatet visade på att ur överlåtarens synvinkel är det förmånligaste sättet att genomföra en generationsväxling genom köp, och då sälja till högsta möjliga pris. Ur övertagarens synvinkel är det förmånligaste sättet att genomföra en generationsväxling genom ren gåva. This thesis describes the taxation of a generation change within the agricultural sector. The aim of the thesis is to describe how both the transferor and transferee may implement a generation change in the best possible way. The thesis also describes how a generation change is carried through in practice, and what is important to consider in this process. Calculations are carried out to establish which of three methods of generation change within the agricultural sector is the least expensive seen from both the transferor’s and the transferee’s perspective. The three methods explored in this case study are purchase, purchase gift, and gift. Conditions and courses of actions within generation change are enacted in the Act of support for engaging agriculture. In addition, also the expertise available from Lantbruksföretagarnas pensionsanstalt (LPA), Svenska lantbrukssällskapens förbund (SLF) and Nordea was used. Österbottens svenska producentförbund r.f. (ÖSP) has also organized an information session on generational change in agriculture, which also contributed information to the thesis. Internet sources through the keywords generation, farmers and agriculture were produced, as these were helpful in creating a complete picture of the problem area. The results indicated that from the transferor perspective, the best way to implement a generation is through the method of purchase, and then sell to the highest possible price. From the transferee point of view, the best way to implement a generational change is by pure gift.
