EU-oikeuden vaikutus vuosilomalain muutoksessa

Abstract

Opinnäytetyön tarkoituksena oli selvittää vuonna 2013 voimaan tulleen vuosilomalain muutoksen taustat ja sovellettavuus käytännön tilanteissa. Työn tarkoituksena oli selvittää, mitkä seikat vaikuttavat vuosiloman siirto-oikeuteen.

Opinnäytetyössä käytettiin laadullista tutkimusmenetelmää, ja työssä yhdistettiin asiantuntijakeskusteluista saatuja tuloksia ja työryhmän tuottamia materiaaleja ja Euroopan unionin tuomioistuimen tapausten tarkastelua.

Tutkimus osoitti, että nykyinen vuosilomalaki ei kata kaikkia käytännön tilanteita, kuten opintovapaata tai työntekijän tilapäistä lomautusta. On siis odotettavaa, että nykyinen vuosilomalaki tulee vielä muuttumaan.

The aim of the present thesis was to explain the backgrounds and applicability in practice of the annual leave law change which came into effect in 2013. The intention was to clarify which reasons have an effect on annual leave transfer rights.

The theoretical part of the thesis focused on the background of the national law change, claimed costs and sick leave practices. A qualitative research method was applied in the thesis. The thesis used the results of expert opinions and materials provided by the Ministry of Employment and the Economy working group and investigated various cases in the Court of Justice in the European Union.

This thesis demonstrated that the current annual leave law does not cover all the practical situations like study leave or temporary dismissal of an employee. Therefore it is expected that the present annual leave law will be modified.
